Hyundai presents the "Mighty Refrigerator Truck 3 Day Test Drive Experience", offering customers the chance to immerse in the benefits of operating the Mighty EX6 Refrigerator, as well as experiencing Mighty's 15.5 feet cargo box with cooling capacity as low as -18°C, and ultra-smooth handling characteristics.
Terms & Conditions
1. Hyundai Hong Kong Company Limited (“we”) agrees to provide the Trial Vehicle described above upon the terms and conditions set out in this agreement.
2. The Driver Representative (“you”) accepts that the Trial Vehicle is provided to you at our discretion as a means of joint promotion and the Trial Vehicle is returnable upon demand by us.
3. You covenant and agree to ensure that the Trial Vehicle is:
  1. used with reasonable care and diligence;
  2. driven only by a person qualified to do so and holding all necessary current licenses and permits in respect of the Trial Vehicle and himself, such licence in respect of the driver to be full and not a provisional driving licence;
  3. not used for driving tuition, racing, speed trials or any other sporting competitions;
  4. not used for carriage of passengers for hire or reward by any means;
  5. not used for carrying goods for hire or reward by any means;
  6. not to be driven outside Hong Kong without our written permission; and
  7. not to be used for any illegal purposes or in manners in contravention of any applicable laws and regulations.
4. You are to pay a refundable deposit of HK$10,000, we will process the refund one calendar month after you have returned the Trial Vehicle, providing there is no new damage, traffic incidents or other issues.
5. You are to give immediate notice to us of the happening of any traffic violations, loss or damage to the Trial Vehicle.
6. You are to report to the Police and give immediate notice to us of any traffic accident involving the Trial Vehicle and undertake to assist us in the investigation and processing of any claim relating to such accident.
7. You must not mortgage, charge, pledge, assign, underlet or lend the Trial Vehicle.
8. As obligations surviving termination of this agreement, you agree to indemnify us against the following arising out of acts or omissions of while the Trial Vehicle is entrusted to you during the term hereof:
  1. All damages, loss, theft or destruction of the Trial Vehicle arising out of and in connection with the use of the Trial Vehicle.
  2. Any claims in respect of loss, injury, damage, costs or expenses arising out of and in connection with the use of the Trial Vehicle, or as a result of any defect in it, or otherwise howsoever caused.
  3. All fines and fixed penalties payable by us by virtue of any statute applicable to the use of the Trial Vehicle.
  4. All excess charges arising out of and in connection with an insurance policy which we maintain with respect to the Trial Vehicle.
9. You shall forthwith deliver up the Trial Vehicle in a condition consistent with the performance of your obligations under this agreement upon demand by us, and this agreement will be terminated upon the return of the Trial Vehicle. Upon termination of this agreement, your right to possess and use the Trial Vehicle shall cease immediately, and we have the right to take possession of the Trial Vehicle, and to recover from you our recoverable losses and any of your pre-existing liabilities to us. If you fail to deliver up the Trial Vehicle as required under this agreement, then you agree to pay to us HKD 1,000 (Hong Kong Dollars one thousand) per day, as liquidated damages, until return of the Trial Vehicle to us.
10. Any expenses incurred by us in recovering possession of the Trial Vehicle on default of delivery by you under Clause 8 will be reimbursed by you to us on demand.
11. The agreement is exclusive to the Driver Representative and is not assignable by the Driver Representative.
12. Driver Representative is required to refuel vehicle from authorized gas stations up to level of the time of car out upon returning and provide the corresponding receipt.
13. This Agreement has been translated into Chinese. If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.
